1. Introduction
Welcome to The Academy Clinic.
These Terms and Conditions apply to:
a. your access to and use of our Website; and b. where stated, your booking, access to and receipt of services provided by The Academy Clinic.
A contract for clinical services is formed when we confirm your appointment or when you attend an appointment, whichever occurs first. Additional terms may apply to particular treatments, appointments, offers, packages or services. Where additional terms apply, they will be provided to you before the relevant service is supplied.
By using the Website, you agree to comply with the provisions of these Terms that relate to Website use. If you do not agree to those provisions, you must not use the Website.
Nothing on the Website constitutes an offer to provide a particular treatment or service. All clinical services are subject to availability, suitability assessment and acceptance by the relevant treating practitioner.
2. Definitions
In these Terms:
Account means any online account created by you to access features or services made available through the Website.
Aftercare Instructions means any oral or written instructions provided to you following an assessment, procedure or treatment.
Clinic Services means consultations, assessments, advice, treatments, procedures, aftercare and any other clinical or associated services provided by or on behalf of The Academy Clinic.
Personal Data means information relating to an identified or identifiable individual.
Privacy Policy means our privacy notice, as updated from time to time, which explains how we collect, use, store and share Personal Data.
Treating Practitioner means the healthcare professional or practitioner responsible for assessing you or providing any treatment, procedure, advice or care.
We, Us, Our and The Academy Clinic mean The Academy Clinic, 5th Floor, Jasper House, 4–6 Copthall Avenue, London, EC2R 7DA.
Website means The Academy Clinic website available at www.theacademyclinic.co.uk and any related online pages, forms or functionality operated by us.
You and Your mean the person using the Website or receiving or seeking to receive Clinic Services.

3.4 We may share relevant Personal Data with Treating Practitioners, authorised employees, service providers, insurers, professional advisers, regulators, law enforcement bodies, safeguarding authorities and other healthcare professionals where this is necessary for your care, the administration of our services, the protection of patients or others, or compliance with law or professional obligations.
3.5 Clinical information and records will be treated as confidential. We may disclose information where:
a. you have authorised us to do so; b. disclosure is necessary for your care or treatment; c. disclosure is required or permitted by law; d. there is a safeguarding concern or a serious risk of harm; e. disclosure is required by a regulator, professional body, court or law enforcement authority; or f. disclosure is otherwise permitted under our Privacy Policy.
3.6 We do not sell Personal Data. We may use appropriately appointed service providers to process information on our behalf.
3.7 We may take and retain clinical photographs where reasonably necessary for assessment, treatment, aftercare, record-keeping or patient safety. Any use of photographs for advertising, marketing, publication, social media or teaching outside your direct care will be subject to separate consent where required.

4. Availability of Services
4.1 The Website and Clinic Services are primarily intended for persons located in the United Kingdom. We do not represent that the Website or Clinic Services are appropriate or available in every country or jurisdiction.
4.2 We do not guarantee that the Website, or any content or functionality on it, will always be available, uninterrupted, secure or free from errors.
4.3 We may suspend, withdraw, restrict or change all or any part of the Website for maintenance, security, legal, regulatory, technical or operational reasons.
4.4 We may decline, defer, limit or discontinue Clinic Services where:
a. the requested service is outside our scope of practice; b. proceeding would be clinically unsafe or inappropriate; c. necessary information has not been provided; d. a suitable Treating Practitioner or facility is unavailable; e. there are safeguarding, regulatory or professional concerns; or f. service capacity does not permit us to accept or continue the appointment.
4.5 Information on the Website is provided for general information only. It is not a substitute for an individual consultation, diagnosis, clinical assessment or personalised medical advice.
4.6 You are responsible for ensuring that anyone who accesses the Website through your internet connection is aware of these Terms and complies with them.
5. Medical Terms
5.1 Clinic Services are not emergency services. If you believe that you are experiencing a medical emergency, call 999 or attend the nearest accident and emergency department. Do not rely on the Website, email, social media or routine clinic contact details for emergency assistance.
5.2 All assessment, diagnosis, treatment and aftercare decisions are made by the Treating Practitioner using their professional and clinical judgment.
5.3 Your suitability for a treatment or procedure will be assessed individually. We do not guarantee that any requested treatment will be offered or that a particular result or outcome will be achieved.
5.4 You must provide complete, accurate and current information about your health, medical history, allergies, medicines, previous treatments, procedures, products used and any other matter that may reasonably be relevant to your care.
5.5 You must promptly tell us or the Treating Practitioner if any information you have provided changes or if you become aware that it was incomplete or inaccurate.
5.6 We may request further information, medical records, photographs, test results or information from another practitioner before deciding whether it is appropriate to proceed. We may defer or decline assessment or treatment until reasonably necessary information has been received.
5.7 Before any treatment or procedure, the Treating Practitioner will provide appropriate information about the proposed treatment, reasonably available alternatives, material risks, expected benefits and likely outcomes.
5.8 You will have an opportunity to ask questions before treatment. You may decline or withdraw consent at any time before the treatment or procedure is carried out.
5.9 Where relevant, you may be asked to sign a separate treatment-specific consent form. That consent form forms part of the agreement relating to the relevant treatment or procedure.
5.10 Certain medicines or devices may, where clinically appropriate and lawful, be used outside their licensed indications. Where this is relevant, the Treating Practitioner will explain this to you as part of the consent process.
5.11 Further consultations, staged treatment, corrective treatment, tests, referral to another healthcare provider or additional aftercare may be recommended where clinically appropriate.
5.12 You must follow all reasonable Aftercare Instructions and promptly seek advice if you experience an unexpected reaction, deterioration or concern following treatment.
5.13 Our ability to assess, treat and support you may be affected if you fail to provide complete and accurate information or do not follow reasonable Aftercare Instructions.
5.14 Clinical reports, advice, images and other materials provided to you are intended for use in connection with your personal care. They must not be altered, misrepresented or used for commercial purposes.
6. Intellectual Property
6.1 Unless otherwise stated, we or our licensors own all intellectual property rights in the Website and its content, including its text, layout, design, graphics, photographs, videos, documents, training materials, branding, databases and software.
6.2 You may view the Website and download or print a reasonable number of pages for your personal and non-commercial use.
6.3 You must not, without our prior written permission:
a. reproduce, republish, distribute, sell or commercially exploit Website content; b. modify, adapt or create derivative works from Website content; c. incorporate Website content into another website, database, publication or service; d. frame or mirror any part of the Website; e. remove copyright, trademark or other proprietary notices; or f. use Website content for advertising, training or commercial purposes.

10.2 We will provide Clinic Services with reasonable care and skill.
10.3 We are not responsible for loss or damage to the extent that it results from:
a. inaccurate, incomplete or misleading information provided by you; b. your failure to disclose relevant medical information; c. your failure to follow reasonable Aftercare Instructions; d. treatment, products or procedures provided by another practitioner or organisation; e. your delay in seeking medical advice; or f. your use of general Website information as a substitute for personalised medical advice,
except to the extent that the loss or damage was also caused by our negligence or breach of duty.
10.4 We are not liable for loss or damage that was not reasonably foreseeable when the relevant contract was formed.
10.5 Where you use the Website or Clinic Services as a consumer, we are not liable for business losses, including loss of profit, revenue, opportunity, business, goodwill or anticipated savings.
10.6 We do not guarantee that the Website or its content will be completely accurate, current, uninterrupted, secure or free from errors, viruses or harmful material. We will take reasonable steps appropriate to the nature of the Website but you remain responsible for using suitable security and virus-protection software.
10.7 Website content is general information only and should not be relied upon as medical advice, diagnosis or a recommendation that a particular treatment is suitable for you.
10.8 Nothing in these Terms affects your statutory rights as a consumer.
11. Waiver
11.1 If we delay or fail to enforce any provision of these Terms, that does not mean that we have waived our rights.
11.2 Any waiver will only be effective if it is given in writing and will apply only to the specific circumstances for which it is given.
11.3 If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary. If modification is not possible, it will be treated as deleted. The remaining provisions will continue in full force and effect.
11.4 These Terms do not give any third party a right to enforce any of their provisions under the Contracts (Rights of Third Parties) Act 1999.
11.5 We may transfer our rights and obligations under these Terms to another organisation, provided that this does not reduce your rights. You may not transfer your rights or obligations without our written agreement.
12. Complaints Policy
12.1 We are committed to providing high standards of care and service. We welcome feedback and will use it to review and improve our services.
12.2 If you are dissatisfied with the Website or any Clinic Service, please contact us as soon as reasonably possible so that we have an opportunity to investigate and respond.

12.4 Please include your name, contact details, the date and nature of the service concerned and a clear explanation of your complaint.
12.5 We will acknowledge and investigate complaints in accordance with our Complaints Policy and will aim to provide a fair and proportionate response.
12.6 If you are dissatisfied with our final response, or if we have not resolved your complaint within the applicable period, you may be entitled to refer the matter to an appropriate redress scheme, regulator or professional body.

12.8 Any referral to an external scheme must be made within the time limit set by that scheme. You should check the scheme's current rules and eligibility requirements before making a referral.
12.9 Nothing in this complaints procedure affects your legal rights.
13. Governing Law and Dispute Resolution
13.1 These Terms and any dispute or claim arising out of or in connection with them are governed by English law.
13.2 If you live in England or Wales, the courts of England and Wales will have jurisdiction.
13.3 If you live in Scotland, Northern Ireland or another jurisdiction, this does not affect any mandatory right you may have to bring proceedings in the courts of the jurisdiction in which you live.
13.4 Before commencing court proceedings, we encourage you to contact us so that we can try to resolve the matter through our complaints process.
14. Animals in the Clinic
14.1 Assistance animals may be permitted in public and clinical areas, subject to an individual assessment of patient safety, infection prevention and control, the nature of the treatment and the needs of other patients.
14.2 Please notify us in advance if you intend to attend with an assistance animal so that we can consider any reasonable adjustments and make appropriate arrangements.
14.3 We may restrict access to a particular treatment room or clinical area where this is reasonably necessary for health, safety, infection-control or clinical reasons. Where possible, we will consider suitable alternative arrangements.
14.4 The handler remains responsible for supervising and controlling the animal and for ensuring that it does not create a risk or unreasonable disruption.
14.5 We will not require a particular identification card or certification unless there is a lawful and reasonable basis for requesting supporting information.
15. Use of the Website
15.1 You may use the Website only for lawful, personal and non-commercial purposes.
15.2 If you are under 18, you should ask a parent or guardian to assist you before booking or purchasing any Clinic Service. Eligibility to receive a treatment or procedure is separate from eligibility to access the Website and will be assessed in accordance with applicable law, professional standards and our clinical policies.
15.3 Where the Website allows you to create an Account, you must provide accurate and current information and keep your login details secure and confidential.
15.4 You must not:
a. use the Website unlawfully, fraudulently or maliciously; b. impersonate another person or provide false information; c. attempt to gain unauthorised access to the Website, an Account, a server, database or connected system; d. introduce viruses, malware or other harmful material; e. interfere with, damage or disrupt the Website or its security; f. scrape, harvest, copy or extract Website data or content using automated means, except where permitted by law or authorised by us; g. infringe our intellectual property rights or the rights of another person; h. upload, transmit or publish unlawful, defamatory, abusive, threatening, discriminatory or infringing material; or i. use the Website for unauthorised advertising, marketing or commercial activity.

16.2 We may decline, suspend or terminate Clinic Services where:
a. proceeding would be clinically unsafe or inappropriate; b. the requested service is outside our scope; c. you fail to provide reasonably required information; d. you fail to follow reasonable clinical or safety instructions; e. there are safeguarding, regulatory or professional concerns; f. you engage in abusive, threatening, discriminatory, violent or unsafe behaviour; g. we cannot contact you after reasonable attempts; or h. agreed fees remain unpaid.
16.3 Where reasonably practicable and clinically appropriate, we will explain the reason for suspending or terminating Clinic Services.
16.4 If we cancel a prepaid Clinic Service before it is provided and you are not responsible for the cancellation, we will refund the relevant prepayment, subject to any separate cancellation terms lawfully applying to the booking.
16.5 Suspension or termination does not affect rights or liabilities that arose before the date of suspension or termination.
16.6 Suspension or termination of Clinic Services does not affect your right to seek emergency medical care from an appropriate emergency service.
17. Changes to Terms
17.1 We may update these Terms from time to time to reflect changes to our services, Website, business practices, legal obligations, regulatory requirements or patient-safety arrangements.
17.2 The current version will be published on the Website and will state the date on which it takes effect.
17.3 Changes will take effect prospectively.
17.4 For a confirmed appointment or prepaid Clinic Service, the terms in force when the booking was confirmed will normally continue to apply unless:
a. a change is required by law, regulation, professional guidance or patient safety; b. the change does not materially disadvantage you; or c. you agree to the revised terms.
17.5 Your continued use of the Website after revised Website-use terms take effect means that you agree to comply with those revised provisions.
